All bookings with us are subject to the following terms and conditions, which form the basis of our contract with you.

Definitions

“Connelly Contours Limited”, “we”, “us”, “our” means Connelly Contours Limited a company registered in England and Wales under company number 15189859. Registered office 2 The Grove, Barham, Canterbury, CT4 6PP.

“You”, “your” means the person making the booking with us.

“Booking” means the services outlined in our Booking Summary, which we provide to you following your enquiry.

The Booking Summary will include price information and payment dates. Your payment of the first payment by the payment date will confirm your booking, and your confirmation that:

  • You have read these terms and conditions, agree to be bound by them, and have the authority to agree that all members of your party will be bound by them.

  • You consent to our use of your personal data, and that of your party, in line with our Privacy Policy.

  • You are over 18 years of age.

  • You accept responsibility for payment in line with the schedule in the Booking Summary.

  • All members of the party are physically able to undertake activities shown in the Booking Summary.

We are responsible for carrying out the services outlined, or the London walk, in the Booking Summary, which we will provide to you following your enquiry.

Where your booking involves a planned itinerary we will endeavour to stick to it as far as possible, but it does not form part of our contract with you, and may be varied at your request, or due to travel or other delays, and circumstances beyond our control.

You are responsible for:

  • Getting you and all members of your party to the start place at the start time.

  • Ensuring appropriate clothing and footwear for the activities included in the booking, and the weather forecast. For all bookings we recommend sturdy and comfortable footwear. 

  • The appropriate behaviour of you and all members of your party.

  • The health and safety of you and all members of your party, and following any guidance given by us during your Booking.

  • Providing all information as agreed to allow us to carry out the booking (where relevant).

  • Battlefield guiding bookings:

    • Making your own travel arrangements, and providing passenger and luggage space for Mark Connelly, from our start date and place until the end date and place.

    • Ensuring any vehicle that we travel in is roadworthy, insured, and driven safely and within the laws of the country you are in.

    • Paying for your accommodation and subsistence expenses, including any site entrance costs, and having the means to pay.

    • Ensuring you have correct travel documentation – passport, visa, vehicle requirements etc – and appropriate insurance cover. We recommend you have European breakdown cover where appropriate.

 Limitation of liability

Our liability is limited to carrying out the services outlined in the Booking. We are not responsible for, will not be held liable for, and will make no refunds for:

  • Acts of omission by your or a member of your party (including but not limited to forgetting a passport, illness or unavailability, failure to be at the start place on time, or leaving early, dropping out of the party, failure to book travel and accommodation)

  • Circumstances outside of our control (including but not limited to travel cancellations or delays; road closures; weather; vehicle breakdown; accommodation unavailability)

  • Accidents and injury, except due to our negligence

  • Other unavoidable or extraordinary circumstances outside of our control (including but not limited to war, terrorist, civil unrest, pandemics, natural disasters).

Where any of the above occurs after the commencement of a booking we will do our upmost to replan and provide acceptable alternatives, but not beyond the booking end date.

To the extent limited by law, our liability to compensate you for any loss or damage howsoever caused is limited to the total amount you have paid for the booking.

Payment terms

Our payment terms depend on the type of Booking:

  • London walks – payment is due in full to confirm your booking.

  • Battlefield guiding - 20% of total cost as a deposit to confirm the booking, with the balance due 8 weeks before the booking start date. 

  • Other services – as laid out in the Booking Summary.

If full payment is not made in line with the payment dates we are entitled to treat the booking as cancelled by you.

Cancellation by you

Under the terms of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your booking, and receive a refund of all payments made, within 14 working days of you confirming our contract by making your payment without giving any reason. To exercise this right to cancel please inform us by email to mark@connellycontours.co.uk.

If you have expressly asked us to start providing the services outlined in the booking before this period has elapsed, you will be required to pay our reasonable costs of the work we have done up to the time of your cancellation within the cancellation period. If the end date and time of the booking has passed prior to your notification of cancellation you will be deemed to have expressly asked us to start providing the services, and will not be entitled to any refund.

Cancellations after this 14 working days period must also be made in writing. If you choose to cancel the following refunds will apply:

London walks

  • More than 14 days before the walk date – total cost less a £10 administration fee per person

  • Less than 14 days before the walk date – no refund

Battlefield guiding

  • Deposits are non-refundable, but may be transferred to a new booking.

  • If you cancel within 8 weeks of the start date, after you have paid the balance of the payment we will refund a percentage of total costs paid less any unrecoverable expenses we have incurred, as follows

  • Up to 5 days before the start date – 0%

  • Between 6 and 14 days before the start date – 20%

  • Between 15 and 27 days before the start date – 40%

  • Between 28 and 56 days before the start date – 60%

Other services

We shall refund an amount equivalent to the sum paid less any time already spent on the booking at the hourly rate shown on Booking Summary and less a 10% administration fee.

Cancellation by us

London walks may be subject to minimum numbers. If any minimum number is not reached by 10 days before the scheduled date a walk may be cancelled. You will be offered an alternative date. If this is not acceptable we will provide a full refund.

Should we need to cancel your booking for any reason we will offer a comparable alternative. If this is not possible we will return all sums paid to you. Our liability will not exceed the amount paid to us.

Complaints

We aim to provide a high quality and satisfactory service at all times, and hope that you will have no reason to complain. If you have any concerns whatsoever we encourage you to raise these as soon as possible so that we can attempt to address them to your satisfaction. If you wish to make a complaint please do so in writing, providing full details.

Please address your complaint to Jacqui Connelly, 2 The Grove, Barham, Canterbury, CT4 6PP or complaint@connellycontours.co.uk. We will acknowledge your complaint as soon as possible and aim to respond promptly and within 28 days. If we cannot complete our investigation and respond within 28 days we will notify you of when we expect to be able to respond. We aim to resolve the matter to your satisfaction, but if we are unable to reach agreement we are willing to consider a mediation service if you wish.

This contract is subject to the law of England and Wales.
